These Terms of Service ("Terms") govern your access to and use of the public marketing website and related informational pages at trylens.in (the "Site") operated by Pluto in connection with the Lens brand ("we", "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Separate terms, order forms, or agreements apply if you become a customer of paid Lens products or services. Those are not covered here.
This document is for general information and does not constitute legal advice. You should obtain independent counsel for your organisation.
1. Eligibility and acceptable use
You may use the Site only in compliance with applicable laws in India and elsewhere that apply to you. You agree not to misuse the Site, including by attempting to gain unauthorised access, introducing malware, scraping in a way that overloads our systems, or using the Site to harass, defraud, or impersonate others.
2. Intellectual property
The Site, including text, graphics, logos, icons, layout, and software, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws in India and internationally. The names Lens and related marks are trademarks used to identify our brand. You may not copy, modify, distribute, sell, or lease any part of the Site without our prior written consent, except as allowed by limited fair dealing or fair use for personal, non-commercial reference where applicable.
3. Demo requests and communications
When you submit a demo request or email us, you represent that the information you provide is accurate and that you have authority to share it. You agree that we may use business contact details you provide to respond and to discuss our products, subject to our Privacy Policy.
4. Third-party links
The Site may link to third-party websites (for example LinkedIn). We are not responsible for their content or practices. Your use of third-party services is at your own risk and subject to their terms.
5. Disclaimers
The Site is provided on an "as is" and "as available" basis for informational purposes. To the fullest extent permitted by applicable law in India, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the Site will be uninterrupted or error-free.
6. Limitation of liability
To the maximum extent permitted by applicable law, we and our affiliates, officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from or related to your use of the Site.
Our aggregate liability for any claim arising from or related to the Site shall not exceed the greater of (a) the amount you paid us specifically for access to this marketing Site in the twelve months preceding the claim (if any), or (b) Indian Rupees five thousand (INR 5,000), except where liability cannot be limited under applicable law (including wilful misconduct or fraud where proven).
7. Indemnity
You will defend and indemnify us against any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Site, except to the extent caused by our wilful misconduct.
8. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to mandatory provisions of law, you agree that courts located in Gurugram, Haryana, India shall have exclusive jurisdiction over disputes arising from or relating to these Terms or the Site, except where another forum is required by statute.
9. Changes
We may modify these Terms at any time. We will update the "Last updated" date when we do. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
